Distance Sales Agreement
This agreement is made between the SELLER identified below and the BUYER, covering the sale and performance of the service ordered electronically through this website, in accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
1. Seller
- Name: [SATICI ADI / UNVANI]
- Address: [ADDRESS]
- Phone: [TELEFON]
- Email: [E-POSTA]
- Tax office: [TAX OFFICE]
- Tax number: [VKN / TCKN]
2. Buyer
The name, address, phone number and email address entered by the BUYER in the order form apply. The BUYER is responsible for the accuracy of this information.
3. Subject
The subject of this agreement is the provision of the service ordered electronically by the BUYER, with the characteristics and price stated in the order summary.
The service consists of consultancy and setup work for creating, verifying, correcting and managing business listings on map and directory platforms (Google, Yandex, Bing, Apple Maps, Facebook). It does not include delivery of any physical product.
4. Service characteristics and price
The type, scope, quantity and VAT-inclusive price are shown in the order summary and on the payment page. Listed prices are current prices; the SELLER reserves the right to update prices, but no additional amount is charged after an order is confirmed.
Payment is made through the secure payment page of the selected payment provider. Card details are never transmitted to or stored by the SELLER.
5. Performance and timing
The SELLER must perform the service within 30 days of receiving payment. In practice setup begins within 1 business day of payment; the verification processes of the platforms themselves are outside the SELLER's control and may take from a few days to a few weeks.
Where the service requires information, documents or platform access from the BUYER, the time until that information reaches the SELLER is added to the performance period, and the BUYER is informed.
6. Right of withdrawal and its exception
For distance contracts covering services, the BUYER generally has the right to withdraw within 14 days of the contract date without giving any reason and without penalty.
However, under Article 15(1)(h) of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for services whose performance has begun with the consumer's consent.
The BUYER therefore gives consent during checkout by ticking the box stating "I request that performance of the service begins before the withdrawal period expires and I understand that I will lose my right of withdrawal." Once this consent is given and performance has actually started, the right of withdrawal ends.
If the BUYER does not give this consent, work does not start until the 14-day period expires.
Where the right of withdrawal applies, notice is sent to `[E-POSTA]` with the order code. The full amount is refunded to the original payment method within 14 days of the notice reaching the SELLER.
7. General provisions
The BUYER acknowledges having read and understood the essential characteristics, price, payment method and performance details of the service and having given the required electronic confirmation.
If the SELLER cannot perform within the agreed period due to force majeure or extraordinary circumstances, the BUYER is informed and may cancel the order; in that case the amount paid is refunded within 14 days.
The SELLER never takes ownership of the BUYER's accounts; the BUYER remains the primary owner of all platform listings.
The SELLER gives no guarantee regarding platform ranking algorithms. The undertaking concerns the proper performance of the service.
8. Disputes
Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence have jurisdiction, up to the monetary limits announced annually by the Ministry of Trade.
By confirming the order the BUYER declares having read, understood and accepted all terms of this agreement.
